SuperStreak Terms of Use

Welcome to SuperStreak. These terms are the agreement between you and Hijinks Online Inc. ("SuperStreak", "we", "us") for using the SuperStreak app and the website superstreak.app. By using SuperStreak, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use SuperStreak.

1. What SuperStreak is (and isn't)

SuperStreak helps you build a daily habit, or break one, with a Champion who cheers you on and confirms your mission when you reach the finish line.

SuperStreak is a motivation and accountability tool. It doesn't give medical, health, or other professional advice, so for that, please talk to a qualified professional.

2. Who can use SuperStreak

You must be at least 13 years old to use SuperStreak, as a Hero or as a Champion. SuperStreak isn't for children under 13.

If you're under 18, or under the age of majority where you live, you need a parent's or guardian's permission to use SuperStreak, and they should read these terms with you. If you're a parent or guardian who lets your teen use SuperStreak, you agree to these terms on their behalf and you're responsible for their use of SuperStreak, including any membership bought on their account.

3. Your account

You sign in with Apple. You're responsible for what happens on your account, so keep your iPhone secure. You can turn on Face ID lock in Settings for extra privacy. Please tell us at support@superstreak.app if you think someone else has used your account.

4. Heroes and Champions

• A Hero sets a mission, a length, and a reward, and invites a Champion.
• A Champion is someone the Hero trusts. Being a Champion is always free, even if you also have a mission of your own as a Hero (only the Hero membership is paid).
• Champions can see the Hero's mission, check-ins, and messages, as described in our Privacy Policy. Only invite someone you're comfortable sharing your mission with.
• Either of you can end the connection at any time: Heroes can change their Champion, and Champions can step down.

5. Rewards

The reward is something you and your Champion arrange between yourselves. SuperStreak never holds, handles, or pays out money or rewards, and we aren't responsible for whether a reward is given. Rewards must not be used for betting, wagering, or any kind of gambling, and SuperStreak must not be used to place or settle bets.

6. SuperStreak membership

• Heroes need a SuperStreak membership to start a mission. The membership is an auto-renewing yearly subscription at the price shown in the app before you buy.
• Payment is charged to your Apple account when you confirm the purchase.
• Family Sharing: you can share your membership with up to five other people in your Apple family group through Apple's Family Sharing. Each person uses their own SuperStreak account and must meet the age requirement in section 2. Shared access ends if the person who bought the membership cancels it or leaves the family group.
• It renews automatically each year unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel your membership in your iPhone's subscription settings, or from Settings in SuperStreak. Deleting the app or your SuperStreak account doesn't cancel the membership.
• Refunds are handled by Apple under its policies. We can't issue refunds directly.
• If your membership ends, your current mission keeps working until it ends, and your Hero record and Achievements stay available. You'll need an active membership to start a new mission.
• Price changes: if the price changes, Apple will tell you in advance, as its rules require, and you can cancel before the new price applies.

7. Messages and acceptable use

SuperStreak is a place for encouragement. When you use it, you agree not to:

• harass, threaten, shame, or bully anyone;
• send hateful, sexual, violent, or illegal content;
• impersonate someone else;
• use SuperStreak for gambling, betting, or anything illegal;
• try to break, overload, copy, or misuse the app or our systems.

You can report a message from the Messages screen. We review reports within 24 hours and may remove content, or suspend or close accounts, that break these terms.

8. Your content

You own what you write in SuperStreak, such as your mission name, reward, and messages. You give us permission to store it, show it to you and the person you share it with, and process it as needed to run SuperStreak. This permission ends when you delete the content or your account, except as described in our Privacy Policy.

9. Our content

The SuperStreak app, name, mascot, designs, and wording belong to us. You may use the app for your own personal use, but you may not copy, sell, or reuse them without our permission.

10. Apple

You downloaded SuperStreak from Apple's App Store, so Apple's standard Licensed Application End User License Agreement also applies. If these terms and Apple's agreement conflict, these terms apply to the extent allowed. Apple isn't responsible for SuperStreak, its content, maintenance or support, or any claims about it; we are. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

11. Changes and availability

We're always improving SuperStreak, so features may change. We may update these terms; if a change is important, we'll tell you in the app before it takes effect. If you keep using SuperStreak after that, the new terms apply.

12. Ending your use

You can stop using SuperStreak and delete your account at any time from Delete account and data in Settings. We may suspend or close an account that seriously or repeatedly breaks these terms.

13. Disclaimers and limits

SuperStreak is provided "as is". We work hard to keep it running and accurate, but we can't promise it will always be available, error-free, or that notifications will always arrive. To the fullest extent the law allows, we aren't liable for indirect or consequential losses, or for anything arising from rewards or arrangements between users, and our total liability to you is limited to the amount you paid for SuperStreak in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that can't be excluded.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the Country of Canada. You hereby consent to the exclusive jurisdiction and venue of courts in Ontario, Canada, and stipulate to the fairness and convenience of proceedings in such courts for all disputes.
